General Agreement Terms
- Displayed base prices are subject to change according to the complexity, difficulty, size and medium of each individual piece.
- The Artist will only accept image references of the character(s). Written references are accepted only if it is to explain the commission idea (ex. Poses, clothing, ect.) or if the character is VERY basic (ex. White wolf, red dragon with black horns, ect.).
- Communications about commissions between Client and Artist will be made only through email ([email protected]) to ensure all information and communications are consolidated in one location.
- The client understands there are subjects the artist is uncomfortable with drawing and that the artist has a right to refuse subjects that fall under the WON'T DRAW category (found on the FAQ page) or any other subjects the artist does not feel comfortable working with.
Commission Process
- Once the commission is placed, the Client will be sent a sketch for verification. Clients will have the opportunity to direct alterations of their commission in the sketch stage only. No more than three (3) free alterations will be made unless the Client wishes to pay for each additional alteration past the original 3 free ones.
- The Artist reserves the right to reject an alteration and come up with a compromise pose if they feel the client's request is too much, unable to be done, or ruins the artistic merit of the piece.
Artist's Rights
- The Artist retains the right to display all commissioned work on any personal website, gallery, or journal. If the commissioned work is a time-sensitive gift the Artist may delay public showcase at the request of the Client, but the Artist will not be refused the right to showcase the commissioned work.
- The Artist retains all the rights to the commissioned work, including the right to make prints and use as examples for advertisement.
- The Artist may recycle sketches and preparatory works that were rejected by the commissioner for other commissions or personal works.
- The Artist will not give out any source files of the commission such as a .PSD or .SAI file under any circumstances
- Nothing made by The Artist may be used in any blockchain-related technology, to include NFTs, cryptocurrency, or future inventions in the space.
- The Client retains all rights to their respective characters. This does not allow them rights to the commissioned image (see Artist's Rights).
- The Client may not profit from the artwork beyond the resale of a physical original painting or drawing (traditional / physical media ONLY). The Client is prohibited from any profit of digital media or digital media made into prints.
- The Client may create prints for personal use only (For example: display in their home or as a convention badge). The Client may also resize or crop the artwork to create icons or wallpapers to be used in non-commercial digital format, but the Client cannot alter the artwork itself unless the Artist has given them explicit written permission.
- The Client may upload the artwork to their personal website or gallery as long as the Client does not upload any high resolution or unwatermarked versions of the artwork. The Client must credit the Artist for their work (ex: Linking to the Artist's public gallery).
Payment Terms
- All payments are to be sent in USD. The Artist will not accept any other forms of currency and any payments not in USD will be rejected and refunded.
- Payments for all commissions are required upfront. The Artist will not begin or accept a commission until payment has been exchanged between Client and Artist in full.
- Payments will be made solely through Paypal.com and any other type of monetary transactions will not be accepted.
- The Client must read, understand and agree to all the above terms before entering into an agreement with the Artist. By sending payment, the Client agrees to the Artist's terms.
- The Artist reserves the right to cancel a commission and issue a refund at any time and for any reason. If the Artist chooses to cancel a commission, the Client will receive a full refund.
- If the Client wishes to cancel their commission during the sketch stage they will be refunded 100% of what they paid and the sketch will be repurposed. The Client retains no rights to this sketch.
- Clients wishing to cancel their commission during or after the line-art stage will be taken care of on a case-by-case basis. Refunds are based on how much work has already been done.
- Any commission that is refunded can and will be recycled for other commissions or personal works (see Artist's Rights). The refunded Client will retain no rights to this work.
